Responding, in part, to concerns raised about funding for special educational needs and disability (SEND) matters, the Department for Education and Ministry of Justice yesterday set out steps to improve disagreement resolution procedures in England. The Government pledges to, among other things, introduce a two-year national trial of the expansion of the First-tier Tribunal SEND powers to make non-binding recommendations on the health and social care elements of education, health and care plans, as well as publish good practice guidance.
The Children and Families Act 2014 and the related Special educational needs and disability code of practice places a greater emphasis than before on the avoidance of disagreements through a person-centred approach to decision-making and open communication between professionals and parents and young people.
